Any order entails unconditional acceptance by the customer of these conditions of sale of the company BOSTON DS.
Delivery delay
The deadlines are given as an indication. A delay in delivery cannot expose us to penalties or to any claim for damages. Our deadlines are modified automatically, without compensation, in the event of force majeure which may possibly lead, at our discretion, to the termination or suspension of our commitments without any formality.
Price
The prices indicated in the order confirmation include the prices of the products, expressed in Euros and in force at the time of the consultation as well as the costs of packaging and transport. The products are delivered to the delivery address indicated by the customer on his order form.
Retention of title
By express agreement, the seller remains the owner of the goods covered by this order until payment by the purchaser of the full price stipulated.
Transport reservations
Any reservations must imperatively be noted on the delivery slip, specifying the nature of the damage: the words "subject to unpacking, damage or counting" have no legal value. Confirmation of reservations (art.105 of the Commercial Code) must be made by registered letter within 2 working days of receipt of the goods and include the information given on the delivery note. If these provisions are not observed, the recipient loses all his rights of recourse against the carrier: the supplier cannot be called upon to replace the latter.
Products
The photographs of the products are not part of the contractual field, the customer always has the possibility of contacting us to obtain additional information on the products presented.
Orders
An email confirming that your order has been taken into account will be automatically sent to you by email. We reserve the right to cancel any order from a customer with whom there is a dispute related to a previous order. All the information provided by the purchasing customer at the time of the order is binding on the latter. BOSTON DS cannot therefore be held responsible for the consequences resulting from errors relating to the wording of the contact details of the recipient or the debtor of the order.
Cancellation clause
In the event of non-performance by the customer of any of the commitments made by him or of one of the obligations resulting from these presents, and eight (8) days after sending by registered letter with acknowledgment of receipt of a formal notice unsuccessful, the sale will be terminated automatically, if we see fit, without prejudice to our right to claim any damages.
Force Majeure
We disclaim all liability in the event of non-performance of the contract due to a case of force majeure within the meaning of article 1218 of the civil code (strike, flood, fire, war, embargo, etc.). This list is not exhaustive.
Jurisdiction
These general conditions of sale are subject to the application of French law. The contractual information is presented in French and the products offered for sale comply with French legislation. In any case, any dispute will be subject to French law, and the competent court will be that of the jurisdiction of our head office.
Protection of minors
Pursuant to Ordinance No. 59-107 of January 7, 1959 and Law No. 2009-879 of July 21, 2009 and in accordance with Article L. 3342-1 of the Public Health Code, the sale of alcohol to minors under the age of 18 is prohibited. Anyone ordering alcohol in our company therefore agrees to be 18 years old on the date of the order. (Alcohol abuse is dangerous for your health. Know how to consume in moderation).
